At Friends of Breathe we are committed to protecting your personal information, and being transparent about what information we hold about you. Using personal information allows us to fundraise and provide you with relevant information about the work that we do.

The purpose of this policy is to give you a clear explanation of how we collect the information from you directly and how we use it. We use your information in accordance with all applicable laws concerning the protection of personal information, and we never sell your data to any third parties.

Who we are: Breathe Arts Health Research is a registered charity in England and Wales. Our charity number is 1176678.

 

Information Collection: We collect various types of information, in a number of ways:

Information you give us: For example, when you make enquiries via email or make a donation, we’ll store personal information you give us such as your name, email address, postal address, telephone number and bank information, where applicable. We will also store a record of your payments and donations.

Information about your interactions with us: For example, when you visit our website, we collect information about how you interact with our content and pages. When we send you an email, we store a record of this.

Sensitive personal data: Data Protection law recognises that certain categories of personal information are more sensitive such as health information, race, religious beliefs and political opinions. We do not collect this type of information about our patrons.

 

Why we use your data – legal basis

There are four bases under which we may process your data:

Contract purposes:When you make a donation to us, you are entering into a contract with us. In order to perform this contract, we need to process and store your data. For example, we may need to contact you by email or telephone in the case of problems with your payment.

Legitimate Business Interests: In certain situations, we collect and process your personal information for purposes that are in our legitimate organisational interests. However, we take care that the way we use your personal data ensures it does not override your personal interests. We describe below all situations where we may use this basis for processing.

With Your Explicit Consent: For any situations where the two bases above are not appropriate, we will instead ask for your explicit consent before using your personal information in that specific situation.

Legal Obligation: In some cases, the processing of your personal information is necessary for us to comply with the law.

 

Other processing activities

We also process personal information in the following ways that are within our legitimate organisational interests:

- We may analyse data we hold about you in order to identify and prevent fraud.

- In order to improve our website, we may analyse information about how you use it and the content and pages with which you interact. Please see our cookies policy for more information.

Third Parties

We will never sell your personal data. However there are certain circumstances under which we may disclose your personal information to third parties. These are as follows:

·         When it is necessary for them to be able to provide you with products or services that you’ve requested.

·         To our own service providers who process data on our behalf and on our instructions (for example our donation processing provider). In these cases we require that these third parties comply strictly with our instructions and with data protection laws, for example around security of personal data.

·         Where we are under a duty to disclose your personal information in order to comply with any legal obligation (for example to government bodies and law enforcement agencies).

 

Cookies

Cookies are small text files that are automatically placed onto your device by some websites that you visit. They are widely used to allow a website to function as well to provide website operators with anonymous information on how the site is being used. Your donation

If you choose to make a donation with us, we will use a third party provider to do administer it. We will ensure that we chose one that operates securely and in accordance with good practice. We currently use Donorbox, whose system is protected by SSL/TLS encryption technology, and their forms are PCI compliant.

They never store card or bank information, and offer 24/7 fraud detection against scammers. You can find out more about Donorbox here.

You may be asked if you would like to sigh up to our beneficiary’s mailing list. You do not need to do so to donate, and you may unsubscribe at any time. Full details can be found on their privacy policy, linked at time of donation.

 

Maintaining your personal information

We do not store personal information. Our donation processing provider offers this option; please read their policy and ensure you are happy with it, ahead of choosing it. If there is information we hold that you believe is inaccurate or that you would like to remove, please get in contact.

Any objections you make to any processing of your data will be stored on our system so that we can comply with your requests.

 

Security of Your Personal Information

We will put in place appropriate safeguards (both in terms of our procedures and the technology we use) to keep your personal information as secure as possible. We will ensure that any third parties we use for processing your personal information do the same.

 

Right to Your Personal Information

Access to information: You have the right to access information held about you.

Right to deletion, rectification, and data export: We permit you to delete, rectify and export information you have provided to us, subject to the conditions of our legal obligations set out below.

Retention: We retain personal data for as long as it is reasonably necessary to comply with our legal obligations (including law enforcement requests), meet regulatory requirements, maintain security, prevent fraud and abuse or resolve disputes

 

Right to your own likeness

For both still and moving images, we will always ensure we have consent to publish them. As with all consent-based items, you are always allowed to revoke your consent at any time, by contacting us.
